Plant warranty info

Fellow scapers,

My partner and I are diligently working on things for next year, and one thing that popped up was warranty work. I need to find out if any of you warranty the replacement plants of the first plants. I also want to find out what your contracts state in regards to this.

Terms & Conditions


All plantings as indicated will be guaranteed as follows:

Trees, shrubs, vines, and perennials are guaranteed for 12 months if there is an irrigation system installed (unless otherwise specified). Where plants die, replacements will be made with plants of the original size and quality as previously specified at no cost to the owner. One replacement for each plant that dies will be made. Transplanted plants from the site have no guarantee, though every precaution will be made to assure their survival.

The above guarantee will not apply where plants die because of chemicals, animal damage, vandalism, fire, storms, hail, drought, insects, exceptional or untimely freeze, or other acts of God, or by any other contingency beyond the landscape contractor’s control.

The owner hereby agrees that for the guarantee to be effective, he/she will water thoroughly at least two times a week during dry periods and weed beds at least twice a month at a minimum.



Dry stack rockwork:

Over time, dry stack rockwork requires routine maintenance by the owner, due to frost and thaw heaves. Change in grades by others can cause failure due to water flow changes. The contractor will insure proper drainage and a stable wall upon completion. Any change in grade forfeits contractor’s responsibility.

Zak, I noticed you said you had been in business 2-3 years. What kind of terms do you have in place now?

I currently have a one year warranty on all plant material put in by us. As for transplants there is no warranty. We also go the extra mile and burlap the material if it is a high dollar item like Acer palmatum disectum or arbs.

Zak - interesting on the dry stack. I didn't even think to put that in a contract and we are doing a ot of that now. We guarantee trees one year, all other plants 90 days one time each . Acts of God, animal damage and lack of /too much water guarantee does not apply.If the landscape is done in the Fall we guarantee through May. But let me add that I normally will replace if a client calls, even if it over the time frame because the little bit I save will cost me in the long run. They know how long it is guaranteed but call anyway. They will get no fight from me ( there are rare exceptions) and it always pays off. One thing I've learned from others on this site that I will add for 2005 to my invoice /bid: I will replace a plant, but there will be a charge for the labor to put the new one in. Most people are happy to get a new plant and will replace it themselves. Many come to pick up a replacement plant from me if it isn't too large.
