I read the RI law too after I posted last night and found that it was not quite as restrictive as I had been told (by several people that I thought should have known). I did however still think it was much too restrictive because I missed the "Landscape Gardener" exemption. That term is ambiguous enough to provide some wiggle room for the design/build firm but unless I missed something else it doesn't provide any wiggling for a design only firm (unless that is what "Private consultants engaging in the practice of professional planning." is supposed to mean. I'm not sure what that means. You're right that it all comes down to enforcement and, as I said, there isn't much.
Life would be a lot simpler if people would write laws that were decipherable. I feel better about the law after looking into it but not so much about the RI General Assembly.
And good to know the NH law is a sensible one.
