Well, let me ask you. How much money a year do you give to a lobbyist so he can grease the politicians palms?
Ands how much would you suppose a railroad lobbyist would give up? So, how do you think that crossing gate rules and regs would be favorable towards?
Every train has a black box in the cab. When the engineer saw the truck, I'm betting there will be something on it and I'm also betting it will be checked. Lots of things to factor in here. Is it OK for the train to run at top speed at that crossing? How far ahead does the train have view of the track? They will ask how far ahead the trucks were from your semi. I mean form the sounds of things, it sounds to e like your driver may have stopped on a track, or perhaps shifted on/over the track all kinds of things they are going to look at. And it does not even pay to worry right now because you really don't know what the outcome will be.
Back in Illinois there was some dummy who drove a steel rig and parked it over a track. It was hit by an Amtrack train at 73MPH, and 11 people were killed. Somehow the driver filed and collected from a work/comp claim...Like hs boss told him to park over the track. It's still in court. That's why you have insurance. I would kick bac a bit until you see how this thing is going to shake out. That's all I'm saying.

This morning an employee of a local landscape company actually went around cars stopped at a crossing and was struck by a train. The small dump was dragged about 60 feet and caught fire. The driver and the passenger died. This was also at an intersection without barriers.

Looks like the site is owned by a trucker.
"Super-chicken"? I didn't see that in any other reports - hoping that was something this guy just made up. If you know tht to be false, you might want to send a formal note to that site owner requesting his comments be amended. Don't want that ending up in court if it isn't the truth.
BTW - How are things going with that?

and i would guarantee that 95% of those truck wrecks were caused by some idiot who cant drive around large trucks and cut them off

I am going to address that Jeff. I find no humor in this, but also not trying to be a square either.
As for the insurance things, no news. My truck is still at the accident site and no plans on moving it to have it fixed, as well as no info on the trailer replacement or compensation. I plan on making a few calls this week to try and resolve this. There has been no communication with me on it, and I have been waiting on the insurance compnay to do their thing. As for the liability side I would imagine that this is going to take a while. A long while.

Just a suggestion....it might be more effective if you have your attorney contact the website administrators at that site....I'll bet they react a lot quicker!!

well looks like the tractor is going to be totaled , common sense told me the trailer was done for, but I found the tractor to be a surprise. No news yet on any liability on the train's part, I guess time will tell.

well the insurance company totalled the tractor, which was a surprise. But I am officially out of the big truck business. Hopefully for good.
We retained and sold the salvage and recovered most of our investment in the rig.
Our new mini excavator is supposed to be ready friday. Hopefully this investment will work out much better than the previous.
as for liability, no word from anyone since our recorded statment the day after the wreck. I guess no news is good news.
