When you get right down to it, it is not a landscape question. It is a question on the integrity of an individual who happens to be in this industry.
No one here can do anything about that. It should not be a referendum on the integrity of the landscape industry or the integrity of some of the people who hire us.
We should not judge Tatz or his landscaper. They are probably both really good guys.
We should all look at this and realize that we all have to understand the importance of returning calls and good ettiquette. It has a huge affect on how we are perceived by our clients and prospective clients.
A lot of you know that I am not big on the idea of letting homeowners participate on this site (I'm just a regular member) mostly because there is so much available to them elsewhere. On those other sites, there is a tendency for the homeowners to attribute the characteristics of the individuals in our industry that they have dealt with to all of us in it. That is why I had a negative reaction to the "you landscapers". It is human nature as it is to be suspicious of the possibility of being used by one of "those homeowners" who represents the worst of whom we have dealt with.
I hope all of us will walk away from this thread with the understanding that "we landscapers" can really stress people out when we are unresponsive for whatever reason. When there is a warranty it is an item just like a patio or swimming pool. It is bought and paid for. there is no difference between not honoring it and not putting the pool in the ground. But, this is less about a warranty and more about being proactive by just returning a phone call.
Let's give Tatz the benefit of the doubt for discussion sake as this scenario plays out from time to time. This poor guy (or another like him) just wants to hear the landscaper say he will honor his warranty. Not hearing that has this guy joining message boards and worrying about lawyers. It is a big stress on him that can be significantly reduced by a two minute call. You can put off the work, but don't put off the communication.
